The Master Builders of Victoria association have released a statement regarding COVID-19 and protocol to be followed for new and existing contracts.
At a high-level, the MBV and its legal department advise all building professionals and parties to building contracts to “ensure they approach the effects of COVID-19 in a generous spirit and work together to reach sensible outcomes.”
The MBV legal department has indicated it may be contacted to assist builders with determining any special considerations or legal options in the wake of delay, frustration and force-majeure (acts of God).
MBV have stated the effects of COVID-19 are beyond the reasonable or immediate control of builders and contractors, however it remains the responsibility of the builder to notify an owner of any possible delay as soon as possible.
MBV’s legal team advises building professionals to familiarise themselves with all current contracts and pay close attention to notification requirements around claims for extension to time. For further assistance, contact the MBV legal team directly.
